Clear It Terms of Service
Effective date: August 30, 2026
Last updated: August 30, 2026
These Terms of Service (“Terms”) govern your access to and use of the Clear It mobile application, website, support services, and related features operated by Clearly Simple Works LLC (“Clearly Simple,” “we,” “us,” or “our”).
By creating an account, pairing a device, accessing Clear It, or otherwise using the service, you agree to these Terms and our Privacy Policy.
1. Clear It’s Purpose
Clear It helps an adult caregiver, family member, or other trusted supporter and an adult recipient work together on everyday reminders.
Clear It can record whether a recipient tapped Done and acknowledged a reminder. It does not verify that medication was taken, an appointment was attended, or any other underlying task was completed.
2. Eligibility and Consent
You must be at least 18 years old and legally able to agree to these Terms.
Only pair with another person who understands and agrees to participate in the Clear It relationship. Do not use Clear It to monitor someone secretly or without their knowledge.
Caregivers are responsible for entering accurate contact information, schedules, linked actions, and reminder content.
3. Accounts and Devices
You are responsible for protecting access to your email account, devices, and Clear It account.
Tell us promptly if you believe an account, device, or pairing has been accessed without authorization. We may restrict access when reasonably necessary to protect a user, another person, or the service.
A recipient device may use an anonymous, device-bound identity rather than a conventional named account.
4. Acceptable Use
You may not use Clear It to:
-
Violate a law or another person’s rights
-
Harass, threaten, deceive, exploit, or secretly monitor someone
-
Submit content you do not have the right to use or share
-
Attempt unauthorized access to another account, device, or record
-
Probe, disrupt, overload, reverse engineer, or interfere with the service
-
Introduce malicious software or harmful content
-
Misrepresent Clear It as an emergency, medical, or monitoring service
-
Use Clear It in a way that could reasonably cause harm
We may limit or terminate access for material violations, security risks, or legal requirements.
5. Sensitive Information
Use the minimum reminder detail needed.
Do not use Clear It to store passwords, complete payment-card numbers, government identification numbers, authentication codes, or unnecessary medical or financial information.
Reminder content is shared with the paired participant and processed by our service providers as described in the Privacy Policy.
6. Notifications and Linked Actions
Apple, Google, mobile carriers, networks, device permissions, battery settings, and operating-system controls may delay or suppress notifications.
We do not guarantee that a notification will be delivered or received at an exact time.
Linked actions may open a third-party phone, text, map, browser, or other service. The caregiver is responsible for checking a linked destination before sending the reminder. Third-party services are governed by their own terms and privacy practices.
7. No Emergency or Medical Service
Clear It is not:
-
An emergency-response system
-
A medical device
-
Medical advice
-
A clinical monitoring service
-
A medication-adherence or task-completion verification service
-
A substitute for professional care
Do not rely on Clear It for an emergency, urgent medical need, or any situation in which a delayed or missed reminder could cause harm.
Contact emergency services, a qualified professional, or another trusted person when appropriate.
8. Your Content
You retain ownership of content you submit through Clear It.
You grant Clearly Simple a limited license to host, store, process, transmit, display, and back up that content only as reasonably necessary to provide, secure, maintain, support, and improve Clear It; comply with law; and enforce these Terms.
You represent that you have the right and permission to provide the content and share it with the paired participant.
9. Intellectual Property
Clear It, Clearly Simple, the associated designs, software, text, graphics, branding, and other service materials are owned by Clearly Simple Works LLC or its licensors and are protected by applicable intellectual-property laws.
Except for the limited right to use Clear It under these Terms, no ownership rights are transferred to you.
10. Feedback
If you voluntarily provide feedback or suggestions, you authorize us to use them without restriction or compensation, provided we do not publicly identify you without permission.
11. Service Changes
We may add, change, suspend, or discontinue features. We will provide notice when reasonably practical.
Beta or test features may be incomplete, contain errors, or change without notice.
12. Privacy
Our Privacy Policy explains how Clear It handles information. It is incorporated into these Terms by reference and is available at:
https://clearlysimpleworks.com/privacy
13. Disclaimers
To the extent permitted by law, Clear It is provided “as is” and “as available.”
We disclaim warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, and guaranteed reminder or notification delivery.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of Liability
To the extent permitted by law, Clearly Simple Works LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes loss or harm arising from:
-
A delayed, missed, or suppressed reminder
-
An inaccurate schedule or linked action
-
User-created content
-
Unauthorized device or email access
-
Reliance on Clear It as an emergency, medical, monitoring, or task-verification service
-
Third-party services opened through a linked action
Applicable law may provide rights or remedies that cannot be limited by these Terms.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Clearly Simple Works LLC and its officers, employees, and agents from third-party claims resulting from your unlawful use of Clear It, your violation of these Terms, or content you did not have the right to provide.
This provision does not apply where prohibited by applicable law.
16. Termination and Account Deletion
You may stop using Clear It at any time.
Account and data-deletion options are described at:
https://clearlysimpleworks.com/delete-account
We may suspend or terminate access for material violations, security risks, operational necessity, or legal requirements.
Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, and dispute provisions—will survive.
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Arbitration Agreement and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED IN COURT BY A JUDGE OR JURY.
Informal Resolution First. Before either you or Clearly Simple Works LLC (“Clearly Simple”) initiates arbitration, the party seeking relief must first provide the other party with written notice describing the dispute and the requested resolution and allow at least 30 days for the parties to attempt to resolve the dispute informally. Notices to Clearly Simple must be sent to info@clearlysimpleworks.com. Clearly Simple may send notice to the email address associated with your Clear It account.
Agreement to Arbitrate. Except for disputes that qualify for small claims court and disputes concerning the infringement or misuse of intellectual property rights, you and Clearly Simple agree that any dispute, claim, or controversy arising out of or relating to these Terms, Clear It, or your use of the service that cannot be resolved informally will be resolved through binding individual arbitration, rather than in court.
Federal Arbitration Act. This arbitration agreement involves interstate commerce and is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16, to the fullest extent applicable. The arbitrator will apply applicable substantive law consistent with the Federal Arbitration Act and these Terms.
Arbitration Rules and Procedure. Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, as modified by these Terms. Information concerning AAA and its rules is available from AAA. If AAA is unavailable or unwilling to administer the arbitration, the parties will attempt in good faith to select another mutually acceptable arbitration provider or, if necessary, request that a court of competent jurisdiction appoint one.
Location and Format. Unless you and Clearly Simple agree otherwise, arbitration may be conducted by telephone, videoconference, written submissions, or in person. If an in-person hearing is required, it will take place in the Commonwealth of Virginia unless applicable law or the arbitration rules require a location reasonably convenient to the consumer.
Individual Proceedings Only. YOU AND CLEARLY SIMPLE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING, to the fullest extent permitted by law. Unless both parties agree otherwise, the arbitrator may not consolidate the claims of more than one person or preside over any form of representative or class proceeding.
Small Claims Court. Either party may bring an individual claim in a court of competent jurisdiction that qualifies as a small claims court proceeding, provided the claim remains individual and within that court's jurisdiction.
Arbitrator's Authority. The arbitrator may award the same individual remedies that would otherwise be available in court, including monetary damages and injunctive or declaratory relief where permitted by applicable law. The arbitrator will issue a written decision sufficient to explain the essential findings and conclusions on which the award is based.
Fees. Arbitration filing, administration, and arbitrator fees will be allocated according to the applicable AAA Consumer Arbitration Rules and applicable law. Clearly Simple will pay fees that applicable law requires it to pay for this arbitration agreement to be enforceable.
Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to info@clearlysimpleworks.com within 30 days after you first accept these Terms. Your notice must include your name, the email address associated with your Clear It account, and a clear statement that you wish to opt out of the arbitration agreement. Opting out of arbitration will not affect the other provisions of these Terms or your ability to use Clear It.
If Arbitration Does Not Apply. If a dispute is not subject to arbitration under this section, you and Clearly Simple agree that, to the extent permitted by applicable law, the dispute will be brought in the appropriate state or federal court located in the Commonwealth of Virginia, and each party consents to the jurisdiction of those courts.
Severability. If any portion of this arbitration agreement is found unenforceable, that portion will be severed to the minimum extent necessary and the remainder will remain in effect, except that if the prohibition on class or representative arbitration is found unenforceable as to a particular claim or requested remedy, that claim or remedy will proceed in court rather than in class or representative arbitration.
18. Changes to These Terms
We may update these Terms as Clear It changes. The updated Terms will be posted with a revised effective date.
When required, we will provide additional notice or request renewed agreement.
